Principles of processing of personal data ensuring the accessibility of Latvenergo Group’s Energy Museum

According to the provisions of Section 13 of Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 On the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter - Regulation), we inform you about the processing of personal data, ensuring the visit to the expositions and the collection storage of Latvenergo Group’s Energy Museum (hereinafter - Energy Museum), organising guided tours and educational classes, purchase of souvenirs, rental of premises, use of collection items and their digital copies at Ķeguma prospekts 7/9, Ķegums, Ogre Region and using the services provided by the Virtual energy museum of the website (https://energetikasmuzejs.lv), as well as visit to the Plaviņas HPP historical exposition at Enerģētiķu Street 2, Aizkraukle, Aizraukle Region.

Aim or purpose of processing data 

Personal data is processed with the purpose to ensure the visit to the expositions and the collection storage, organising guided tours and educational classes, purchase of souvenirs, rental of premises and use of collection items or their digital copies at Ķeguma prospekts 7/9, Ķegums, Ogre Region, visit to the Plaviņas HPP historical exposition at Enerģētiķu Street 2, Aizkraukle, Aizraukle Region and services provided by the Virtual energy museum (https://energetikasmuzejs.lv).

Personal data that we process 

In order to ensure the availability of the Energy Museum and/or Plaviņas HPP historical exposition in person, when applying for a visit, we will ask you to indicate your name, surname, telephone number, e-mail address, number of adults/minors in the group, date, time of the visit and preferred tour language. If you submit comments, we will also process the following information. In addition, for the visit to the Energy Museum, please indicate whether you want to visit the exposition and/or storage, and indicate the type of service you want − an educational class or a guided tour.

When purchasing tickets for an in-person visit to the Energy Museum, attending excursions or educational classes and souvenirs, we will process your as the customer’s name, surname, type and number of purchased goods, e-mail address to which we will send the purchased tickets and invoice (if applicable). If you wish to pay for the services by bank transfer, please indicate the VAT number if you are a VAT payer, and the billing details for drafting and sending the invoice.

In order to ensure your ability as a consumer to exercise the 14-day right of withdrawal from the distance contract, as well as the right to submit a claim for non-compliance with the terms of the contract, please indicate your name, surname, address and/or contact information in the withdrawal form or application, as well as information about the purchased product.

If you book premises at the Energy Museum or would like to receive a service for the use of collection items or their digital copies, we will ask you to provide your name, surname, phone number and e-mail address, purpose of use, VAT number, if you are a VAT payer, and billing details for invoicing and sending.

In order to ensure the protection of persons, property and legal interests, we may use the data recorded in the recordings of video surveillance cameras located in the facilities of Latvenergo AS and adjacent territories - image of you and/or your vehicle, date, time and place of recording, as well as information demonstrating your behaviour and the actions taken. We will also process the information you have provided during the communication with us, for example, in correspondence or a telephone conversation.

If you want to visit the Energy Museum free of charge, then at the entrance we will ask you to present a document confirming your status, which confirms that you correspond to one of the following groups of museum visitors with free admission: Honorary Family or 3+ Family Card holder, orphan, person with disabilities and person accompanying him or her, politically repressed person, International Council of Museums (ICOM) member, employee of Latvian museums or media representatives covering Museum events.

If you would like to apply for the use of the image for your own purposes in the Digital Collection section of the Virtual Energy Museum and/or provide additional information about the object or event shown in the selected image, then when sending a message to the Energy Museum, in addition to your comment, please indicate your name and e-mail so that we can contact you.

The legal (juridical) grounds for processing

In order to prepare for your visit to the Energy Museum and/or Plaviņas HPP historical exposition, ensure the course of the visit, provide services related to the rental of premises or use of collection items or usage services of their digital copies and souvenirs purchase services at the Energy Museum, we will process personal data on the basis of Section 6, Paragraph 1, Subparagraph b) of the Regulation.

In order for us to contact you about the application submitted in the Digital Collection section of the Virtual Energy Museum and/or to the e-mail address muzejs@latvenergo.lv for using the image of the selected collection object for your needs and/or for the provision of additional information about the image, as well as to evaluate the validity of your received claims, provide evidence and store personal data in the event of a potential dispute for a certain period of time until the dispute is resolved, as well as defend our infringed legal interests and prevent and detect security risks to the protection of persons and property, we will process personal data in accordance with Section 6, Paragraph 1, Sub-paragraph f) of the Regulation.

When administering payments made by transfer, we will keep accounting records in accordance with Article 6, Paragraph 1, Sub-paragraph c) of the Regulation and the Accounting Law.

Who receives your personal data

Personal data will be processed by the authorised employees of the Controller in accordance with the scope specified in their job responsibilities, observing the requirements of personal data protection and other laws and regulations, as well as the personal data processing requirements specified in the Controller's internal regulations.

Personal data may be handed over to:

  • outsourcing service providers (processors) of the Controller, who are authorised to perform certain data processing activities on behalf of and under the supervision of the Controller, for example, security service providers;
  • service providers who ensure the exchange of information between the Controller and financial service providers;
  • audit and audit service providers;
  • under certain circumstances (for example, if a complaint is received about the relevant service), the data may be transferred to law enforcement or supervisory authorities, the court, as well as to the Controllers' processors - legal service providers.

It is not planned to transfer the personal data to recipients located outside of the countries of the European Union or European Economic Area.

How long we keep your data for

The information specified in the application for your visit, premises rental or services for the use of collection items will be stored for no longer than 1 (one) month from the date of the receipt of the service.

The information recorded by the video surveillance camera will be stored for a maximum of 60 (sixty) days, unless the video surveillance recording reflects wrongful acts or actions that may help the Controller or third parties to protect their legal interests, in which case the relevant video recording may be retained until the moment when the legal interest is guaranteed.

The message sent to the Energy Museum in the Digital Collection section of the Virtual Energy Museum next to the specific image, your name and e-mail address will be stored for no longer than 1 (one) year from the date of receipt of the message.

Information on issued invoices and information related to payments will be stored for at least 5 (five) years, in compliance with the provisions of the Accounting Law.

If a complaint is received or the Controller's legal interest is violated, for example, a dispute arises about the service received or damage is caused during the visit, the relevant information may be retained until the dispute is settled, for example until the final judgment of the court.

Rights of the data subject (You)

Right of access. You have the right to access your personal data and to receive from Latvenergo AS information on processing of your personal data. Using the Controller's contact information, you may request information about the processing of your personal data if the information provided in these Principles does not seem sufficiently exhaustive.

Right to rectification. If you notice inaccuracies in your personal data, you have the right to request that Latvenergo AS corrects inaccurate personal data.

Right to erasure. You have the right to request that Latvenergo AS deletes your personal data if:

  • personal data are no longer necessary in connection with the purposes specified in the Principles for which they were processed;
  • personal data is unlawfully processed;
  • You have objected to processing and the legitimate reasons of Latvenergo AS are not more important than your legitimate reasons;
  • personal data must be deleted in accordance with the requirements of regulatory enactments.

Please note that the right to erasure does not apply in cases where, in accordance with the laws and regulations, Latvenergo AS is obliged to process personal data or the processing is necessary for archiving, public interest or statistical purposes, as well as for the bringing, implementing or defending a lawful requirement.

Right to restrict the processing of data. You have the right to request that Latvenergo AS restricts the processing of your personal data if:

  • You believe that the data is being processed illegally or is inaccurate (the restriction will be effective while the non-contentious appeal process is in progress);
  • You believe that the processing is illegal but you do not wish to delete these personal data;
  • You have objected to processing and as long as it is not verified whether the legitimate reasons of Latvenergo AS are more important than your legitimate reasons;
  • Latvenergo AS no longer requires your personal data for achieving a certain purpose, but you need it to protect your legal interests and rights.

Right to object to processing. You have the right to object to the processing of your personal data at any time based on the legitimate interests set out in the Principles. Latvenergo AS has the right to continue processing your personal data if Latvenergo AS indicates compelling legitimate reasons for processing that are more important than your interests, rights and freedoms, or for the establishment, exercise or defence of legal claims.

Right to portability. You have the right to receive your personal data that you have submitted to Latvenergo AS in an orderly, transferable and electronically scanned format, and you have the right to request that this data be sent to another Controller if these personal data are processed for the performance of a contract pursuant to Article 6, Paragraph 1, Sub-paragraph b). Please note that you can only claim portability rights in relation to the personal data you have provided to us.

Right to lodge a complaint. You have the right to lodge a complaint to Latvenergo AS, as well as to the Data State Inspectorate (Elijas iela 17, Rīga, pasts@dvi.gov.lv), if you believe that Latvenergo AS has violated your rights or has not sufficiently protected your personal data. However, before contacting the Data State Inspectorate, please contact Latvenergo AS.

Procedure for the submission of requests

For the realisation of all the above-mentioned rights, you may use the contact information of Latvenergo AS specified in these Principles, indicating the following personal data in the request: name, surname, personal identification number, postal address (if you wish to receive a reply by registered mail) or e-mail address (if you wish to receive the answer to the email address).

We invite you to submit your request in one of the following ways:

send a free-form application electronically to the e-mail address info@latvenergo.lv, muzejs@latvenergo.lv or fpda@latvenergo.lv, signing the application with a secure electronic signature;

send your signed free-form application by post to: Latvenergo AS; Pulkveža Brieža Street 12, Riga, LV-1230;

submit your signed free-form application in person at the address of the Controller at the Energy Museum, Ķeguma prospekts 7/9, Ķegums, Ogre Region or at the Plaviņas HPP historical exposition at Enerģētiķu Street 2, Aizkraukle, Aizkraukle Region.

General provisions

The Controller may make changes to the Principles at any time and will provide notification about them by publishing the current version of the Principles on its website.
