General Terms and Conditions for Online Purchase of Electronic Tickets, Services and Products of Latvenergo Group Energy Museum

(Distance Agreement)


  1. General information
    1. These General Terms and Conditions for the Online Purchase of Electronic Tickets, Services and Products of Latvenergo Group Energy Museum (hereinafter - the Terms and Conditions) provide the general conditions for the online purchase of electronic entrance tickets (hereinafter - the E-ticket), services and products of Latvenergo Group Energy Museum (hereinafter - the Museum), which apply to the buyers (hereinafter - the Buyer) purchasing the Museum tickets, services and products - Museum souvenirs (hereinafter - the Products) on the online platform (hereinafter - the E-store).
    2. The Buyer is a natural person or a legal entity who uses the E-store and makes or could potentially make a purchase of E-tickets, products and/or services. The Buyer can be both a Consumer within the meaning of the Consumer Rights Protection Law and a person who is not a consumer.
    3. The provisions of Sections 5 and 7 of these Terms and Conditions do not apply to Buyers who are not Consumers within the meaning of the Consumer Rights Protection Law.
    4. The sale of E-tickets, services and products in the E-store, as well as the provision of the Museum services is ensured by the Latvenergo AS, registration No. 40003032949, registered address Pulkveža Brieža iela 12, LV-1230 (hereinafter - the SERVICE PROVIDER).
    5. The SERVICE PROVIDER shall sell the Museum E-tickets, Museum services and products:
      1. entrance tickets, guide, educational services and products at the Museum located at Ķeguma prospekts 7/9, Ķegums, Ogre Municipality, Latvia, LV-5020 (hereinafter - the Museum in Ķegums).
      2. The description, specification and prices of the Products and Services are indicated in the E-store in the selection window of each respective Product and Service.
      3. The prices of the Products and Services in the E-store are indicated in euros with the valid VAT rate.
      4. The SERVICE PROVIDER shall be responsible for the quality of the provided services and products, information or advertising.
      5. The rights and obligations related to the purchase of E-tickets, services and products shall be determined by the SERVICE PROVIDER.
      6. The SERVICE PROVIDER reserves the right to unilaterally amend, correct or supplement the Terms and Conditions. The current version of the Terms and Conditions is available on the SERVICE PROVIDER'S website: https://latvenergo.lv/en/energetikas-muzejs/distances-ligums.
      7. Before choosing each purchase, the Buyer has the opportunity to get acquainted with these Terms and Conditions and Personal Data Processing Principles of Latvenergo AS, ensuring the accessibility of Latvenergo Group Energy Museum.
      8. By making a payment, the Buyer confirms that he/she has read and agrees to these Terms and Conditions.
  2. Purchase and payment procedure
    1. The Buyer shall purchase the Museum E-ticket, services and products in the E-store using links from the sections “Museum”, Excursion application forms of the Latvenergo AS website: https://latvenergo.lv/en/piesakies-ekskursijai and www.muzeji.lv: https://muzeji.lv/lv/muzeji-latvija/museum/latvenergo-energetikas-muzejs.
    2. Before purchasing E-tickets and services, the Buyer shall book the visit time of the Museum on the website of Latvenergo AS in the Excursion application form: https://latvenergo.lv/en/piesakies-ekskursijai.
    3. The Buyer shall purchase E-tickets, services and products online in the E-store by selecting the type and number of E-tickets and/or services and/or products and providing the following data:
      1. Date, month and year of the Museum visit;
      2. name, surname and e-mail address;
      3. legal entities shall additionally provide the company's registration number and telephone number;
      4. VAT payers shall additionally provide a VAT payer registration number.
    4. The Buyer shall get acquainted with these Terms and Conditions and make a corresponding mark.
    5. The Buyer may pay for the purchase of E-tickets, services and products:
      1. with a Visa or MasterCard payment card, indicating the relevant card number, security code and card validity period in the shopping bag;
      2. by bank transfer, paying the invoice sent electronically by the Service Provider. when paying by bank transfer, the invoice number must be provided.
    6. The Buyer shall be responsible for ensuring that before purchasing E-tickets and services, he or she has made sure that he or she is not part of any groups of museum visitors to whom free admission is provided in accordance with the “Latvenergo Group Energy Museum Price List” approved by Latvenergo AS Management Board Decision No. 139/44 of 31.08.2021 “On the Introduction of Paid Services in Latvenergo Group Energy Museum” (hereinafter - the Price List) and available at https://latvenergo.lv/en/energetikas-muzejs/cenradis.
    7. The prices of E-tickets, services and products may change until the Buyer has placed E-tickets, services and products in his or her shopping bag and paid for them.
    8. At the place of service provision the SERVICE PROVIDER is entitled to check the compliance of the necessary documents for the persons to whom free admission applies in accordance with the Price List.
  3. Delivery terms
    1. If the Buyer chooses to pay with a Visa or MasterCard payment card, the E-ticket in PDF format and/or an invoice for the purchase of the service - guide or educational classes and/or products shall be sent to the e-mail address provided by the Buyer after the transaction and receipt of payment.
    2. If the Buyer chooses to pay by transfer, the invoice shall be sent to the e-mail address provided by the Buyer. The e-ticket shall be sent in PDF format to the e-mail address provided by the Buyer after the transaction has been completed and payment has been received.
    3. The SERVICE PROVIDER shall not be liable for any delay or non-delivery if it has occurred because the Buyer has provided an inaccurate e-mail address or it has not been delivered due to the Buyer's e-mail server filters or other technical reasons or restrictions.
    4. The SERVICE PROVIDER is not responsible for cases when the E-ticket sent to the Buyer and/or invoice sent from the Buyer’s e-mail, data carrier or printout becomes available to third parties and is used without the consent of the Buyer.
    5. Before arriving at the Museum, the Buyer must print an E-ticket and/or an invoice for the purchase of services and/or products to present them to the Museum staff in person, or the E-ticket and/or invoice can be presented on a smart device. The Buyer must make sure that the text of the E-ticket and/or invoice and the E-ticket code are clearly legible and available for presentation before visiting the Museum and using the services and/or receipt of products.
    6. The Buyer can receive the products purchased in the E-store in person at the Museum in Ķegums. The SERVICE PROVIDER shall not ensure that the purchased products are sent by post or courier. Upon receipt of the products, the Buyer shall check the conformity and number of purchased products.
    7. If the Buyer has not received an E-ticket and/or an invoice for the purchase of the service and/or product, he/she must inform the SERVICE about it by sending an e-mail to the address muzejs@latvenergo.lv or by calling +371 67728988 on working days from 09:00 to 17:00. If the fact of payment is confirmed and a technical error has occurred or other reasons have arisen for why the Buyer has not received the E-ticket or service purchase invoice, the SERVICE PROVIDER shall ensure that the E-ticket or service invoice is sent to the Buyer's e-mail address again.
  4. Liability
    1. The SERVICE PROVIDER is entitled to restrict the visiting of certain premises when providing the services during special events without notifying the Buyers in advance. In such cases, payment for the purchased E-tickets and services shall not be refunded.
    2. The SERVICE PROVIDER may cancel any purchase if there is a suspicion of the possible fraudulent nature of the transaction. A person may be held liable for such criminal transaction in accordance with the Criminal Law of the Republic of Latvia.
    3. At the time of purchase, the SERVICE PROVIDER does not check the Buyer's right to make a purchase or the Buyer's right to free admission, does not verify the accuracy of the data provided by the Buyer and is not responsible for the consequences if the Buyer provides incorrect data, including an incorrect e-mail address for receiving the E-ticket and/or invoice or incorrect Museum visit time.
    4. The Buyer undertakes not to interfere with the operation of the E-shop, including not copying, reproducing, publishing data on other electronic communications sites, as well as not downloading information.
    5. By using the E-store for the purchase of E-tickets, services and products, the Buyer confirms and agrees to:
      1. follow these Terms and Conditions;
      2. not use a payment card of the third parties or their access data to other payment means to pay for E-tickets, services and products;
      3. follow the rules indicated on each E-ticket; Violation of the Terms and Conditions of Use entitles the SERVICE PROVIDER to temporarily or permanently block the Buyer's access to the museum's E-ticket and service sales website and/or cancel the purchases made.
  5. Right of refusal
    1. The Buyer, as a consumer who has purchased products in the E-store, may withdraw from a distance agreement for the purchase of products within 14 days, without giving a reason. The right of refusal expires after 14 (fourteen) days from the date you have received the purchased products in your possession.
    2. In order to exercise the right of refusal, the Buyer shall by means of an unambiguous statement containing information identifying the Buyer (name, surname, e-mail address) and information about the purchased product (name, price, number, date of purchase/receipt), inform the SERVICE PROVIDER of the decision to cancel the distance agreement for the purchase of the products. The Buyer may use the sample refusal form available in Clause 5.10 or submit a free-form notification of the exercise of the right of refusal.
    3. Notice of the exercise of the right of refusal may be given to the SERVICE PROVIDER in the following ways:
      1. by sending by mail to the address: Museum, Ķeguma prospekts 7/9, Ķegums, Ogre Municipality, Latvia, LV-5020;
      2. by delivering in person at the Museum, Ķeguma prospekts 7/9, Ķegums, Ogre Municipality, Latvia, LV-5020;
      3. by sending in electronic form to the SERVICE PROVIDER'S e-mail address muzejs@latvenergo.lv.
    4. The time limit for the right of refusal shall be deemed to have been observed if the notice of exercise of the right of refusal is sent before the expiry of the right of refusal.
    5. The Buyer shall, without undue delay, but no later than within 14 (fourteen) calendar days after sending the notice on the exercise of the right of refusal, return or deliver the products to the SERVICE PROVIDER in person at the Museum located at Ķeguma prospekts 7/9, Ķegums, Ogre Municipality, Latvia, LV-5020. The deadline shall be met if the Buyer sends or returns the products before the expiry of the 14-day period. The Buyer shall bear the direct costs of returning the products.
    6. The products shall be undamaged, in good visual condition and unused. The Buyer shall only be liable for the depreciation of the products if the products have been used for purposes other than determining the nature, characteristics and functioning of the products.
    7. If the Buyer exercises the right to refusal from the distance agreement for the purchase of products, the SERVICE PROVIDER shall refund the Buyer all payments received from the Buyer for the products without undue delay and in any case no later than 14 days from the date the Service Provider was notified of the Buyer's decision to cancel the distance agreement for the purchase of products. A refund is made using the same means of payment as was used by the Buyer for the initial transaction, unless the Buyer has expressly agreed otherwise. In any case, no fee will be charged to the Buyer in connection with such refund.
    8. The SERVICE PROVIDER may withhold a refund until it has received the products back, or the Buyer has provided proof that the products have been returned, whichever is earlier.
    9. In accordance with Paragraph 22.12 of Cabinet Regulation No. 255 adopted on 13 June 2014 “Regulations Regarding Distance Agreements”, the right of refusal, indicated in the Consumer Rights Protection Law, permitting unilateral withdrawal from the purchased service within 14 days if the E-ticket and/or service is purchased using a distance agreement (online), is not applicable to the purchase of Museum e-tickets and services.

  6. Return of e-tickets and services
    1. The Museum does not accept for return or change purchased E-tickets, nor does it return money for paid services, except for in cases when the Museum is not operational on the date specified in the E-ticket, for which the E-ticket was purchased, or if the Museum cannot provide the purchased service at the time booked by the Buyer.
    2. E-ticket is valid and the purchased service is available on the website of Latvenergo AS in the Excursion application form: https://latvenergo.lv/en/piesakies-ekskursijai on the booked Museum visitation date and time. The visitation time can be changed by calling the number +371 67728988. The Buyer is responsible for timely arrival at the Museum in order to visit the Museum and receive the purchased services at the time booked by the Buyer.
    3. In the case that the Museum does not work or cannot provide the services purchased by the Buyer on the day for which the E-ticket was purchased and/or the time of receipt of the purchased service booked, the SERVICE PROVIDER shall refund the money for the purchased E-tickets and services to the Buyer no later than within 10 (ten) working days using the same means of payment as the Buyer used for the initial transaction, based on the Buyer's application in free form, which the Buyer can send to the e-mail address muzejs@latvenergo.lv. The application shall include the following information: name, surname, e-mail address, type of ticket and/or service, price, intended receipt date, month, year of the ticket and/or service, ticket number. After sending the application to the SERVICE PROVIDER, the E-ticket is no longer valid for visiting the Museum and the purchased service can no longer be received. The SERVICE PROVIDER only refunds the Customer the nominal value of the E-ticket and/or paid services. No other additional costs, such as transport costs, will be reimbursed.
  7. The Buyer's rights in the case of non-compliant products
    1. If the Buyer is a consumer within the meaning of the Consumer Rights Protection Law, the Buyer may file a claim with the SERVICE PROVIDER for non-compliance of the products with the provisions of the Distance Agreement within 2 (two) years from the date of receipt of the products. The Buyer shall submit a claim application to the SERVICE PROVIDER within 2 (two) months from the day when the non-compliance of the products with the provisions of the Distance Agreement is discovered, by sending a free-form application containing the Buyer's identification information (name, surname, e-mail address), price, number, date of purchase/receipt, description of the defect) in one of the ways specified in Clause 5.3 of the Terms and Conditions.
    2. A Buyer to whom a product that does not comply with the provisions of the Distance Agreement has been sold may impose one of the following requirements on the SERVICE PROVIDER:
      1. eliminate the non-conformity of the product free of charge and within a reasonable time;
      2. exchange the product for the same or an equivalent product, which would ensure compliance with the provisions of the Distance Agreement;
      3. cancel the Distance Agreement and refund the amount paid for the product;
      4. reduce the price of the product proportionately.
    3. First of all, the Buyer sets one of the following requirements for the SERVICE PROVIDER:
      1. eliminate the non-conformity of the product free of charge and within a reasonable time;
      2. exchange the product for the product, which would ensure compliance with the provisions of the Distance Agreement;
    4. The SERVICE PROVIDER may refuse to eliminate the non-compliance of the product with the provisions of the Distance Agreement or exchange the products if this is not possible or would create the SERVICE PROVIDER costs that are disproportionate, taking into account the value of the products without non-conformity and a degree of non-conformity.
    5. If the Buyer has requested that the Distance Agreement be cancelled, the Buyer shall return the product to the Seller at the expense of the SERVICE PROVIDER and the SERVICE PROVIDER shall refund the amount paid to the Buyer at the time the product is received or the consumer provides proof that the product has been returned. Non-compliant products can be sent or delivered in person at the Museum, Ķeguma prospekts 7/9, Ķegums, Ogre Municipality, Latvia, LV-5020. A refund is made using the same means of payment as was used by the Buyer for the initial transaction, unless the Buyer has expressly agreed otherwise.
    6. If the non-compliance of the product with the provisions of the Distance Agreement is insignificant and cannot significantly affect the Buyer's ability to use the product, the Buyer may not request the Seller to cancel the Distance Agreement and refund the amount paid for the product.
    7. The SERVICE PROVIDER shall not be responsible for the fact that the products in the E-store online may not correspond to the actual size, shape and colour of the products due to the characteristics of the display used by the Buyer.
  8. Other Provisions
    1. As part of the purchase of e-tickets, services and products, as well as the receipt of services, the SERVICE PROVIDER shall process the personal data provided by the Buyer in accordance with the Principles of Personal Data Processing of Latvenergo AS, ensuring the availability of Latvenergo Group Energy Museum.
    2. It is forbidden to use the purchased E-tickets and products for commercial purposes, incl. advertising or marketing campaigns without the written permission of the SERVICE PROVIDER.
    3. Copying and resale of E-tickets is prohibited.
    4. All disputes arising between the Buyer and the SERVICE PROVIDER shall be resolved in accordance with the laws and regulations of the Republic of Latvia - in court.
    5.  If the Buyer has any claims regarding the received service, then he/she must submit a relevant application to the SERVICE PROVIDER identifying the Buyer, as well as the reasons for the application. The application shall be sent to the registered address of the SERVICE PROVIDER or electronically to the e-mail address muzejs@latvenergo.lv.
